Referral Co Terms of Service

By using the Referral Co Daisychain website ("Service"), or any services of Referral co LLC ("Referral Co"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). Violation of any of the terms below will result in the termination of your account. Referral Co reserves the right to update and change the Terms of Service from time to time. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time on this page.

Account Terms

You must provide your organization’s legal full name, a valid email address, and any other information requested in order to complete the signup process.
You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
You are responsible for maintaining the security of your account and password. Referral Co cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
You are responsible for all Content posted and activity that occurs under your account.
If you are using a free account you are not permitted to block ads.
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must provide a reward for your customers through your referral program at least as valuable as publicly available through your own site. If you are found to not have followed this rule, Referral Co reserves the right to charge its standard commission structure (as displayed on the Pricing page) on up to 1% of your site revenue as reported to us by your provider.

Cancellation and Termination

If you cancel the Service before the end of your current paid up cycle, your cancellation will take effect immediately. If you have any pending fees or charges (such as from sales generated from the Service), Referral Co will either charge your payment method available on file prior to cancellation or send you an invoice to settle your balance.
All of your Content will be immediately deleted from the Service upon cancellation. This information can not be recovered once your account is canceled.
Referral Co, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Referral Co service, for any reason at any time. Such termination of the Service will result in the deletion of your Account. Referral Co reserves the right to refuse service to anyone for any reason at any time.
As invoicing is based on services already rendered, Referral Co operates with a strict no refund policy for all plans offered (including, but not limited, monthly and annual plans).

Modifications to the Service and Prices

Referral Co reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
Prices of all Services, including but not limited to monthly or annual subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Referral Co Site (Daisychain.la) or the Service itself.
Referral Co shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
When using PayPal as your payment service, you are expected to comply with the PayPal Acceptable Use Policy.

Copyright and Content Ownership

All content posted on the Service must comply with U.S. copyright law.
Referral Co does not pre-screen Content, but Referral Co has the right (but not the obligation) in their sole discretion to remove any Content that is available via the Service.

General Conditions

Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
You understand that Referral Co uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Referral Co, or any other Referral Co service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Referral Co.
You hereby grant to Referral Co the right to use your name, logo and details of the referral program offered to your advocates and customers on our website and other materials to identify you as our customer for our business purposes, including marketing, case studies and customer references. You also grant Referral Co the right to list your referral program in a publicly available directory which has the purpose to increase the number of advocates and customers to your referral program. For such purpose, you provide permission to Referral Co to use publicly available information regarding your own products and offering and to re-use some of that information for the purpose of that public directory.
We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Referral customer, employee, member, or officer will result in immediate account termination.
You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
You must not upload, post, host, or transmit unsolicited email, SMSs, or "spam" messages.
You must not transmit any worms or viruses or any code of a destructive nature.
Referral Co does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
You expressly understand and agree that Referral Co shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Referral Co has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
The failure of Referral Co to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Referral Co and govern your use of the Service, superceding any prior agreements between you and Referral Co (including, but not limited to, any prior versions of the Terms of Service).
The aggregate liability of Referral Co. LLC and all Referral Co entities (including entities directly or indirectly controlled by, or under common control with Referral Co. LLC) for all claims under this Terms of Service will not exceed an amount equal to the sum of all subscription fees received by Referral Co. LLC from you.
Nothing in this clause applies to exclude or limit Referral Co. LLC’s liability to the extent that a claim is as a result of dishonesty, fraud, wilful misconduct or wilful concealment by Referral Co. LLC, its agents or advisers.
This Terms of Service, and this clause, is governed by the laws of the United States of America. The Parties agree to submit to the exclusive jurisdiction of the courts of the United States of America.

We are Referral Co. LLC, the company that runs the Daisychain service. We’re also known as Daisychain. Here’s a summary of how we protect your data and respect your privacy.

Who this policy is for

This policy applies to any user of our Site (located at daisychain.la) or Services, including retailers, agents, and others who have an account with Daisychain ("Retailers") and customers of Retailers or people referred to Retailers ("Customers").

If you are a Customer of a Retailer who is running a referral program using Daisychain, you should also check the privacy policy of the Retailer that the referral program is for.

When we collect data

When you visit our website and use our service

Whenever you interact with Daisychain, we collect your data. Sometimes we request you provide us with data, sometimes data about you is collected automatically (we call this "log data").

When you voluntarily submit information to us

We collect data like your email address and name that you voluntarily submit to us (such as registering to use the Daisychain service or signing up for a webinar).

Information About Children

Daisychain is not intended for or targeted at persons under 16. By using this site, you represent that you are not under the age of 16. We do not knowingly collect information about children under 16. If you believe that we have collected information about a child under 16, please contact us at help@daisy-chain.io, and we will delete such information.

Information we collect from third parties

We may receive personal data about you from Retailers providing it directly to us (such as after you have purchased from the Retailer), third parties including partners with which we offer joint marketing activities with or have integrations with, and from publicly available sources such as social media websites that you choose to connect with Daisychain

Contact details

Your name, email address, social media accounts (when you choose to connect with Daisychain), address, telephone number.

Log Data that identifies you

Log Data may include information such as your IP address, browser details, timezone, geolocation information, login details, operating system and version.

Data from Retailer's store

Details about and from the Retailer's store, orders Customers make and tracking data for those orders.

Data on how you interact with Daisychain

Usage information about how you interact with Daisychain which may include information on clicks, pages visited, actions taken, errors encountered.

How we use the data we collect

We do not sell personal information for commercial purposes

We do not sell your personal data to other organizations for commercial purposes. We only use your data for your referral program. If our service is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to provide our services to you.

We only use your data for reasons that we have a legal basis to do so.

You can choose not to provide us with personal data

In instances where you are presented the option of providing us with personal data, you can decline to do so. If you decline to do so, you can still browse our website page, but we will not be able to run a referral program for you.

You can change the settings in your browser to turn off cookies. You can also delete cookies in your browser settings. Note that certain features of our service may not function properly without the aid of cookies.

Opt out of Emails

Merchants and Customers can always opt out of receiving emails from Daisychain by following unsubscribe instructions in emails sent by Daisychain or by emailing us at help@daisy-chain.io.

Your rights

You have the following data protection rights:

Right to access information that we have on you

If you request it, we will provide you this information within one month of the request, unless doing so would adversely affect the rights and freedoms of others. We will let you know if we are unable to do so because of that reason.

Right to correct inaccurate personal data

If you want us to correct any other personal data that you aren't able to correct yourself, you can email us at help@daisy-chain.io with a request to do so.

Right to object the use of your data for profiling or making automated decisions about you

We use your data to figure out what information is relevant to you to give you a better experience (like using your usage information to determine content of emails sent to you or determining what to show you on your dashboard). We will only do this to provide and improve the Daisychain service.

Right to port your data to another service

If you request it, we will hand you a copy of your data in CSV format so you can provide it to another service. We will not do so if the request adversely affects any rights and freedoms of others.

Right to be forgotten by us

You can ask us to delete any personal data that we have about you, provided that it is no longer needed for us to use that data for purposes of your use of Daisychain.

Right to lodge a complaint regarding our use of your data

You can address any complaints to the supervisory authority in the Member State of your residence or place of work. Before you do so, please bring it up with us so we can address your concerns.

How we protect your data

We take data protection seriously. We have a variety of administrative and electronic measures that are designed to protect your personal data against unauthorized access, use or disclosure.

Third parties who process your data

We use third parties to help us to offer and run the referral program for you. When we do this, sometimes we need to share your data with them for their services to work well. The sharing only happens when it is strictly necessary and done so with the safeguards and practices detailed in this privacy policy.

There are also instances where you voluntarily connect third party services to your Daisychain account. When you do so, we may need to share your data with them in order to provide you a seamless experience running your referral program.

How long do we store your data

We keep your data as long as you're using Daisychain, and in backups after you've stopped using Daisychain for up to 6 months.

Where do we store your data

Your data is stored through Amazon's databases on a secure server. We might transfer and store the data we collect from you somewhere outside the European Economic Area (‘EEA’). People who work for us or our suppliers outside the EEA might also process your data.

How we respond to Do Not Track (DNT)

Because there is no legal or industry standard at this time, we do not respond to "DNT" signals. We are closely monitoring the work of the privacy community to determine when such a response is appropriate and what form it should take.
